Context (to help the question make sense):
You are playing a MD (muIti-day) diplo game with strangers on the internet, and it's turn 3. There are two people in particular we are gonna look at. Person A and Person B. You are going to judge the action B takes. The host has made the game so if one chooses to surrender, they don't turn AI but they can't come back (so their lands go neutral the following turn). And auto-boot is on. These are the two scenarios:
1) A has decided he's had enough and surrendered. B, seeing that A has surrendered as seen on the players' list, decides to add some orders to take A's land because why not? He's not coming back.
2) A has forgotten to take his orders. Oops. B takes a calculated risk (seeing there's only a few hours on the clock, and maybe he's seen that he lives in country x where it's 3am in the morning .. maybe) and sets orders to attack A.
What is your verdict? All opinions of those used to MD diplos allowed. Whether it's your opinion or what you are used to seeing in game.
P.S Unspoken diplo rules is defined as rules that most or everyone should follow. I expect the host of a game can choose to change this through their game's rules.
